Terms of Service and Conditions of Use

1. Introduction and Acceptance

Welcome to IL Aduanas Costa Rica. By registering and using our international locker and import management services, you agree to be legally bound by these Terms of Service and Conditions of Use. If you do not agree with these terms, please do not use our services.

2. Service Description

IL Aduanas offers international locker services in Miami, United States, allowing customers in Costa Rica to make purchases at U.S. stores and receive their products through our international consolidation and shipping service. Our services include:

  • Assignment of a personal locker in Miami, Florida
  • Reception and temporary storage of packages
  • Customs clearance management in Costa Rica
  • Home delivery or office pickup
  • Merchandise insurance (optional)

3. Registration and User Account

To use our services, you must register by providing truthful, complete, and up-to-date information. It is your responsibility to maintain the confidentiality of your access credentials. You are responsible for all activities that occur under your account.

IL Aduanas reserves the right to suspend or cancel accounts that violate these terms or show fraudulent or suspicious activity.

4. Use of the International Locker

4.1 Shipping Address: Upon activating your account, you will be assigned a unique address in Miami that must be used exclusively for your personal purchases. Sharing this address with third parties is not permitted.

4.2 Permitted Products: Only the importation of products for personal use is allowed. The following are strictly prohibited:

  • Firearms, ammunition, or explosives
  • Illegal or controlled substances
  • Perishable products without authorization
  • Merchandise for resale without commercial permits
  • Counterfeit items or those violating copyrights
  • Hazardous or flammable materials
  • Any product prohibited by the laws of Costa Rica or the United States

4.3 Storage: Packages will be stored free of charge for a period of 30 calendar days. After this period, a storage fee of $2.00 USD per day per package will apply.

5. Pre-Alerts and Notifications

It is the client's responsibility to create a pre-alert in the system for each package sent to the locker. Pre-alerts must include accurate information regarding content, value, and courier. IL Aduanas is not responsible for non-pre-alerted packages that may be lost or delayed.

6. Rates and Payments

6.1 Pricing Structure:

  • Service cost is calculated based on volumetric weight or actual weight (whichever is greater).
  • Differentiated rates apply according to the type of merchandise.
  • Customs taxes are calculated according to the regulations of the General Directorate of Customs of Costa Rica.
  • Merchandise insurance is optional and is calculated as 2% of the declared value.

6.2 Payment Methods: We accept payments via bank transfer, SINPE Móvil, credit/debt cards, and PayPal. All payments must be made prior to the shipment of the merchandise.

6.3 Taxes: Import taxes are the sole responsibility of the client and are calculated based on the declared value of the merchandise, product type, and current regulations in Costa Rica.

7. Shipping and Delivery Process

7.1 Delivery Times: Delivery times are estimates and may vary based on:

  • Flight availability and consolidations.
  • Customs processes in Costa Rica.
  • Weather conditions or force majeure situations.
  • Random inspections by customs.

7.2 Home Delivery: Deliveries are made on business days during working hours. The client must be available to receive the package and present a valid ID.

8. Declaration of Value and Content

The client is responsible for declaring the real value of the merchandise in the system. Under-declaring values constitutes a violation of customs laws and may result in:

  • Fines and sanctions by the authorities.
  • Confiscation of merchandise.
  • Permanent suspension of the account.
  • Legal liability of the client.

IL Aduanas reserves the right to verify values and contents, and may refuse the shipment of packages with suspicious declarations.

9. Inspection and Repacking

IL Aduanas reserves the right to inspect the contents of packages to verify they do not contain prohibited items. In case of consolidation, we may repack products to optimize space and costs. Original packaging may be discarded if it does not affect product integrity.

10. Merchandise Insurance

10.1 Basic Coverage: All shipments include basic coverage of up to $100 USD at no additional charge.

10.2 Extended Insurance: For higher values, we recommend purchasing extended insurance at 2% of the declared value. The insurance covers:

  • Total loss of the package during transport.
  • Damage caused by improper handling.
  • Theft or loss while in the custody of IL Aduanas.

10.3 Exclusions: Insurance does NOT cover:

  • Damage to fragile products without proper packaging
  • Electronic items without original packaging
  • Customs delays due to incomplete documentation
  • Confiscation due to prohibited or regulated items
  • Damage due to natural disasters or force majeure

11. Liability and Limitations

IL Aduanas acts as a logistics intermediary and customs agent. Our responsibility is limited to the proper handling of merchandise within our facilities and the correct management of customs procedures.

We are not responsible for:

  • Factory defects or problems with purchased products
  • Delays caused by international couriers
  • Customs withholdings due to incorrect documentation from the client
  • Changes in regulations or taxes
  • Damage to products without proper packaging
  • Loss of commercial opportunity or indirect damages

12. Claims and Dispute Resolution

12.1 Claims Process:

  1. Claims must be submitted in writing within 5 business days following delivery
  2. Must include photographs of the packaging and damaged product
  3. The purchase invoice and declaration of value are required
  4. IL Aduanas will investigate and respond within 10 business days

12.2 Resolution: In the case of valid claims, compensation will be limited to the insured value of the merchandise or $100 USD (whichever is less) if extended insurance was not purchased.

13. Privacy and Data Protection

IL Aduanas is committed to protecting the personal information of its clients in accordance with the Law on the Protection of Personal Data of Costa Rica (Law 8968). Your data will be used exclusively for:

  • Processing of shipments and customs procedures
  • Communication regarding the status of your packages
  • Billing and collections
  • Improvement of our services

We do not share personal information with third parties without your explicit consent, except when required by law or necessary to complete the service (couriers, customs, etc.).

14. Modifications to the Terms

IL Aduanas reserves the right to modify these terms at any time. Changes will take effect immediately upon their publication on the website. It is the client's responsibility to periodically review these terms. Continued use of our services after any modification constitutes acceptance of the new terms.

15. Suspension and Termination of Service

IL Aduanas may suspend or terminate service to any client who:

  • Violates these terms and conditions
  • Attempts to import prohibited items
  • Provides false or fraudulent information
  • Has outstanding balances for more than 30 days
  • Performs activities that put the operation at risk

16. Applicable Law and Jurisdiction

These terms are governed by the laws of the Republic of Costa Rica. Any dispute will be resolved in the competent courts of San José, Costa Rica. The client accepts the exclusive jurisdiction of said courts.
